Last TallyThis end-user licence agreement covers the Last Tally app itself. It meets the app stores’ minimum licence terms and sits alongside the Terms of Service, which govern the game service and form part of this licence.
Acknowledgement
This licence is concluded between you and Lunana Global Inc. only, not with Apple Inc. or Google LLC, and Lunana Global Inc., not the platform operator, is solely responsible for the app and its content. The Terms of Service are part of this licence; where they conflict on a matter concerning the app store you obtained the app from, this licence prevails.
Scope of licence
You receive a non-transferable licence to use the app on any Apple-branded products you own or control, as permitted by the Usage Rules in Apple’s Media Services Terms and Conditions (which also allow access through Family Sharing where offered), or, for the Android app, on devices you own or control as permitted by Google Play’s terms. You may not distribute the app, make it available over a network where several devices could use it at the same time, rent, lease, lend, sell, or sublicense it, or reverse-engineer, decompile, or modify it, except as the law permits. This licence also covers updates we provide.
Maintenance and support
Lunana Global Inc. is solely responsible for maintenance and support of the app, at hello@lasttally.com. The platform operator has no obligation whatsoever to provide maintenance or support.
Warranty
To the maximum extent permitted by law, the app is licensed “as is”, without warranty of any kind. Lunana Global Inc. is solely responsible for any warranty that cannot be disclaimed. If the app fails to conform to an applicable warranty, you may notify the platform operator, and it will refund the purchase price (if any). To the maximum extent permitted by law, the platform operator has no other warranty obligation, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are Lunana Global Inc.’s responsibility.
Nothing in this licence limits guarantees or rights that your local consumer law makes mandatory.
Product claims
Lunana Global Inc., not the platform operator, is responsible for addressing any claims by you or a third party relating to the app or your possession and use of it, including product-liability claims, claims that the app fails to conform to a legal or regulatory requirement, and claims under consumer-protection, privacy, or similar legislation.
Intellectual property claims
If a third party claims that the app or your possession and use of it infringes their intellectual-property rights, Lunana Global Inc., not the platform operator, is solely responsible for investigating, defending, settling, and discharging that claim.
Legal compliance
You represent and warrant that you are not located in a country subject to a Canadian or U.S. government embargo, or designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any Canadian or U.S. government list of prohibited or restricted parties.

Third-party terms
You must comply with applicable third-party terms when using the app, such as your wireless data agreement and the terms of the store you obtained the app from. If you obtained the app from Google Play, nothing in this licence overrides the Google Play Terms of Service.
Third-party beneficiary
Apple and Apple’s subsidiaries are third-party beneficiaries of this licence, and once you accept it, Apple will have the right (and will be deemed to have accepted the right) to enforce it against you as a third-party beneficiary.
Virtual items and saved progress
Virtual currencies and items in the app are licensed, not sold, have no value outside the game, and are governed by the Terms of Service. Paid currency never expires. Progress and consumable items are stored on your device; non-consumable purchases can be restored through your store’s restore function. In-app purchases are processed by the platform operator, and refunds follow its policies except where the law provides otherwise.
Limitation of liability
The limitations and exclusions of liability in the Terms of Service, including their exceptions for rights the law does not allow us to limit, apply equally to this licence.
Privacy
How the app handles data is described in the Privacy Policy.
Term and termination
This licence is effective until terminated. It ends automatically if you fail to comply with it, and you may end it at any time by deleting the app. When it ends you must stop using the app and delete all copies.
Governing law
This licence is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Disputes are handled as set out in the Terms of Service: in the courts of Vancouver, British Columbia, or where you live if your local law allows, and always subject to the mandatory consumer rights of your place of residence.
