These terms are the contract between you and Lunana Global Inc. for playing Last Tally. The short version: play fair; you get a licence to play, and virtual items are licensed to you, not sold; paid currency never expires; refunds go through the app store; your progress lives on your device; and if something goes wrong, email us first. You always keep the consumer rights your local law gives you. The details follow.
The agreement
Last Tally (the “Game”) is published by Lunana Global Inc. (“we”, “us”). These terms cover the Game, its online features, and this website (together, the “Service”). By installing or playing the Game, or by tapping to accept these terms, you agree to them. If you do not agree, do not play. The Privacy Policy and the App Licence form part of this agreement; on matters concerning the app store you downloaded the Game from, the App Licence prevails.
Who may play
You must be at least 13 years old, or older if your country sets a higher minimum age for using online services without parental consent (in Quebec, players under 14 need a parent’s consent). If you are under the age of majority where you live, a parent or guardian must review and accept these terms for you and is responsible for your purchases, and you need their permission before buying anything. Paid randomized items, if the Game ever offers them, are only for players aged 16 or older, or older where the law requires. You may not play if we have previously banned you.
Your licence to play
We grant you a limited, personal, non-exclusive, non-transferable licence to install and play the Game on devices you own or control, for your own non-commercial entertainment. We may revoke it if you breach these terms. You may not copy, modify, distribute, sell, rent, reverse-engineer, decompile, or create derivative works from the Game, except where the law expressly allows it despite this clause.
You may stream and publish videos of your own gameplay, including on monetized channels, as long as you do not suggest that we sponsor or endorse you. We may ask you to remove content that breaks these terms.
Your player identity and progress
The Game does not use accounts. On first launch it creates a random player identifier that is stored on your device, and derives your public callsign (for example “PILOT-7F3A”) from it. Your progress, settings, and consumable items are stored on your device and tied to that identifier. If you delete the Game, reset or lose your device, or move to a new device, we may be unable to restore them. Non-consumable purchases can be restored through your app store’s restore function. If we add optional accounts or cloud saves later, these terms will describe them. Player identifiers may not be sold, shared, or transferred.
Virtual items and currency
The Game may include virtual currency, lives or respawns, equipment, aircraft, cosmetics, and other virtual items (“Virtual Items”), which you can earn by playing or buy.
- Licensed, not sold. Buying or earning a Virtual Item gives you a limited licence to use it in the Game. You do not own it, it has no real-world value, and it cannot be redeemed for money or anything else of value.
- No trading. Virtual Items cannot be sold, traded, gifted, or transferred outside features we provide.
- Paid currency never expires. Consumable items such as lives, respawns, or boosts are used up when you use them.
- Changes. We may adjust Virtual Items and game balance only for reasons such as keeping matches fair, fixing bugs or exploits, stopping cheating, meeting legal or platform requirements, or adding and retiring content. We will not reduce the paid currency you hold except as described under “Purchases, prices, and refunds” (refunds, chargebacks, and error corrections). If a change materially harms Virtual Items you paid for, we will tell you in the Game, and any right your local law gives you to end the contract and receive a remedy still applies.
Purchases, prices, and refunds
Purchases are made through the Apple App Store or Google Play under that store’s terms; we never see your full payment details. The store shows every price in your local currency before you buy, and items priced in Virtual Items show their price in the Game. Virtual Items are delivered to the device and player identifier used for the purchase.
Except where the law or the store’s policy requires otherwise, all purchases are final. Refund requests go to the store (for Apple, reportaproblem.apple.com; for Google Play, its refund process). If a purchase is refunded or charged back, we may remove the Virtual Items that purchase granted (or an equivalent amount if they were already spent), and only those. We will not lock your progress because of a payment dispute. If we price or grant something in error, we may correct it; if an error charged you, contact us and the store.
Randomized items
If the Game offers Virtual Items with random outcomes, it will show the probability of receiving each item or item type before you buy, along with any guarantee after a set number of draws and how duplicates are handled. No particular outcome is guaranteed except as stated. We will not change the odds of an offer while it is on sale without updating the disclosure first, and we keep a dated record of every change. Paid randomized items are limited to the ages set out in “Who may play” and may be unavailable in some countries.
Online play and fair play
Online features, such as Squadron Showdown and wingman invites, need an internet connection and may not always be available. Matchmaking may place you with other players and fill open seats with AI pilots. You agree not to:
- cheat, including bots, macros, automation, modified or unofficial clients, tampering with the Game’s memory or network traffic, or exploiting bugs you should reasonably know are bugs;
- manipulate matches, including colluding with opponents, teaming up with other solo players, win-trading, deliberately disconnecting to deny a result, or using several devices to boost yourself;
- disrupt the Service, including flooding or denial-of-service attacks, probing it for vulnerabilities, or reaching it by any means other than the Game client we ship;
- buy, sell, or advertise player identifiers, Virtual Items, or boosting services for real-world value; or
- harass, threaten, or abuse other players.
We use gameplay telemetry and automated checks to detect cheating (see the Privacy Policy). Consequences scale with how serious and repeated the breach is: a warning, removal of Virtual Items or progress gained through the breach, a temporary suspension from online play, or a permanent ban of the player identifier. To appeal, email hello@lasttally.com with your callsign and what happened, and we will review it and reply.
Historical content
Last Tally is historical fiction set in the Pacific War of 1941–1945. Its lead pilots and their squadrons are fictional composites; real people, units, ships, and events are dramatized, and some scenes are invented. The Game depicts the war from both the American and the Japanese side. Showing a nation, its forces, or its insignia is for historical context and is not an endorsement of any government, ideology, or military cause. The Game depicts combat and wartime death.
Aircraft, ship, and unit names are used for historical reference. We are not affiliated with, sponsored by, or endorsed by any aircraft manufacturer, armed force, or government, and any trademarks belong to their owners. Some character portraits, artwork, and voice performances are created with the help of AI tools; where AI-assisted content resembles a real person, it is a dramatization.
Ownership
The Game and the Service, including code, art, audio, characters, names, and other content, are owned by Lunana Global Inc. or its licensors and protected by intellectual-property law to the extent those rights exist. Third-party assets used under licence are credited in the Game. Except for the limited licence in these terms, no rights are granted to you. If you send us feedback or suggestions, we may use them without any obligation to you.
Updates, availability, and shutdown
The Game is a live service. We may patch, rebalance, add, or remove content, and may require an update before you can keep playing online. Online features may be interrupted for maintenance or outages. If we decide to permanently shut down the Game’s online service or stop selling Virtual Items, we will give at least 60 days’ notice in the Game or on this site, and we will stop selling paid currency when we announce it. Except where the law requires, no refund is owed for unused Virtual Items at shutdown.
App stores
You obtain the Game through a platform such as the Apple App Store or Google Play. That platform’s own terms also apply to your download and purchases, and the platform operator is not responsible for the Game or these terms. The App Licence contains the terms the platforms require.
Ending this agreement
You can end this agreement at any time by deleting the Game, and you can ask us to delete your data as described in the Privacy Policy. We may suspend or end your access if you materially or repeatedly breach these terms, or where the law requires. When the agreement ends, your licence ends and you lose access to your Virtual Items; no refund is owed for them except where the law requires one.
Disclaimer of warranties
To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
Nothing in these terms limits warranties, guarantees, or rights that your local consumer law makes mandatory.
Limitation of liability
To the extent permitted by law, Lunana Global Inc. will not be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits, data, or goodwill, arising from or related to the Service. Our total liability for all claims is capped at the greater of the amount you paid us in the 12 months before the claim arose and CAD $100.
This clause does not exclude or limit liability that cannot be excluded or limited by law, including for death or personal injury caused by negligence, fraud, gross negligence, or wilful misconduct, or your statutory rights as a consumer.
Indemnity
To the extent permitted by law, you will indemnify Lunana Global Inc. against claims and costs (including reasonable legal fees) arising from your breach of these terms or your misuse of the Service, except to the extent we caused the loss. This clause does not apply where your local consumer law does not allow it.
Changes to these terms
We may change only the following parts of these terms: descriptions of the Game’s features, modes, and Virtual Items; the fair-play rules and how we enforce them; the list of platforms and service providers; online availability and support contacts; and anything we must change to comply with law or platform rules. We will not change the refund or cancellation terms, or your rights under “Disputes and governing law”, to your detriment without your agreement.
We will announce a material change in the Game or on this site at least 30 days before it takes effect, showing the new text and the text it replaces, and update the effective date above. If you do not accept a change, you may stop using the Service and end this agreement, at no cost and without penalty, before the change takes effect. Where the law allows, continuing to play after that date means you accept the revised terms.
Disputes and governing law
Talk to us first. Most problems can be fixed by email. Please write to hello@lasttally.com with the details and give us 30 days to try to resolve it. This is a request, not a condition: it does not limit your right to go to court or to a small-claims court or tribunal, and we agree that any limitation period is paused during those 30 days.
These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. This choice does not deprive you of the protection of mandatory laws of the place where you live. Disputes may be brought in the courts of British Columbia sitting in Vancouver, British Columbia, or, for claims within its limits, before British Columbia’s Civil Resolution Tribunal. If your local law lets you bring a claim in the courts or a small-claims tribunal where you live, you may do so there. Nothing in these terms requires arbitration.
General
If any provision of these terms is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. We are not responsible for failures caused by events beyond our reasonable control. You may not assign this agreement; we may assign it to an affiliate or to a successor in a merger or sale, and will tell you if we do. These terms, together with the Privacy Policy and App Licence, are the entire agreement between you and us about the Service. These terms are written in English; if we provide a translation, the English version controls to the extent the law allows.
